General Terms and Conditions of Service

LAST REVISED: FEBRUARY 22, 2026. PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING CINARK, YOU AGREE TO BE BOUND BY EVERY CLAUSE DESCRIBED HEREIN.

1. Contractual Relationship

These Terms govern the access or use by you, an individual, from within any country in the world of applications, websites, content, products, and services made available by Cinark. Your access and use of the Services constitutes your agreement to be bound by these Terms, which establishes a contractual relationship between you and Cinark. If you do not agree to these Terms, you may not access or use the Services.

2. The Cinark Platform (AI Ecosystem)

Cinark provides a specialized digital infrastructure for the exhibition and distribution of movies generated exclusively or primarily through Artificial Intelligence (AI).

The Service: Cinark acts as a hosting and streaming intermediary. We do not guarantee the artistic quality or the "truthfulness" of AI-generated content.
AI Compliance: By using the platform as a Filmmaker, you warrant that your movie does not violate the ethical guidelines of the AI models used (e.g., OpenAI, Midjourney, Kling, Luma) and that you possess sufficient rights to the prompts and outputs generated.

3. Intellectual Property and Licensing

3.1 License to Cinark: You retain ownership of your content. However, by uploading a movie, you grant Cinark a non-exclusive, worldwide, perpetual, irrevocable, transferable, royalty-free license, with the right to sublicense, to use, copy, modify, create derivative works of, distribute, publicly display, and publicly perform such content in all formats and distribution channels now known or hereafter devised.

3.2 User Restrictions: You may not: (i) remove any copyright, trademark or other proprietary notices; (ii) reproduce, modify, prepare derivative works based upon, distribute, license, lease, sell, resell, transfer, publicly display, publicly perform, transmit, stream, broadcast or otherwise exploit the Services except as expressly permitted by Cinark.

4. Limitation of Liability and Indemnity

FORCE MAJEURE AND BEYOND: CINARK SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST DATA, PERSONAL INJURY, OR PROPERTY DAMAGE RELATED TO, IN CONNECTION WITH, OR OTHERWISE RESULTING FROM ANY USE OF THE SERVICES, REGARDLESS OF THE NEGLIGENCE (EITHER ACTIVE, AFFIRMATIVE, SOLE, OR CONCURRENT) OF CINARK, EVEN IF CINARK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to indemnify and hold Cinark and its officers, directors, employees, and agents harmless from any and all claims, demands, losses, liabilities, and expenses (including attorneys' fees) arising out of or in connection with: (i) your use of the Services; (ii) your breach or violation of any of these Terms; (iii) Cinark's use of your User Content.

5. DMCA Policy (Copyright Infringement)

Cinark respects intellectual property rights. If you believe that any movie on our platform infringes upon your copyright, you must submit a notification to our Legal Department including: a physical or electronic signature, identification of the copyrighted work, and contact information.

6. Governing Law and Arbitration

Except as otherwise set forth in these Terms, these Terms shall be exclusively governed by and construed in accordance with the laws of the jurisdiction where Cinark is incorporated. Any dispute shall be settled through binding arbitration.
